TFP Portfolio Collaboration Terms
A TFP Session is offered at a reduced price because it is a portfolio collaboration. By booking at the TFP price, you personally permit MayerPix to use selected photographs of you from this Session for two groups of uses: (A) MayerPix's own portfolio, website and social-media channels, as ordinary, unpaid posts; and (B) publications about MayerPix or photography, competitions, awards, exhibitions and professional presentations. That permission lasts five years from the Session date. It is the condition of the TFP price: if you do not accept it, you cannot book at the TFP price. It never includes advertising, products or licensing to others unless you separately allow expanded commercial use, and it never includes any use of artificial intelligence. You must be 18 or older, and every other adult who will be photographed accepts these Terms personally before the Session.
TFP Portfolio Collaboration Terms
What these Terms are
1.1 Who they are between. These Terms are between you — the adult who will be photographed in a TFP Session — and Peter Mayer, doing business as MayerPix Photography ("MayerPix").
1.2 What they cover. They cover a TFP Session booked with MayerPix at the TFP price, as shown in the Booking Snapshot for that Booking. They state the permission you give MayerPix as the condition of that price, what the Session includes, what you may do with your images, and what happens if the Session does not go ahead or produces nothing usable.
1.3 In addition to the Agreement. These Terms apply in addition to the MayerPix Photography Services Agreement you accept when booking. Where these Terms expressly provide otherwise for a TFP Session, these Terms apply to that point; otherwise the Agreement applies.
1.4 You accept them personally, before booking. You accept these Terms yourself, before the Booking is made and before any payment. Accepting the Agreement does not accept these Terms, and no one can accept them for you. If more than one adult is to be photographed in the same TFP Session, each other adult accepts these Terms personally, through the link MayerPix provides, before the Session.
1.5 Adults only. A TFP Session is for adults. MayerPix does not offer a TFP Session to, or photograph, anyone under 18 under these Terms.
The TFP price and the condition
2.1 A paid Session at a reduced price. A TFP Session is a paid Session. The price, the deposit, the balance and when the balance is due are stated in the Booking Snapshot.
2.2 The condition. The permission in section 3 is the condition of booking at the TFP price. It is not a consequence of paying, attending, receiving a gallery link, receiving photographs, or anything that happens later. If you do not accept it, you cannot book at the TFP price.
2.3 Nothing is taken from you later. Accepting the permission is a condition of booking. It is never used after the Session as a reason to withhold your photographs, delay your gallery, or ask you for anything more.
The permission you give
3.1 What you permit. You permit MayerPix to use selected photographs from this Session in which you are recognizable for: (A) MayerPix's own portfolio, MayerPix's own website, and MayerPix's own social-media channels as ordinary, unpaid posts; and (B) publications about MayerPix or photography, competitions, awards, exhibitions, and professional presentations.
3.2 What you do not permit by these Terms. This permission is not full rights, all rights, a blanket permission, a permanent permission or a transfer of ownership. Unless you separately allow expanded commercial use under section 5, it does not allow MayerPix to use your photographs in paid advertising; on merchandise, prints or products for sale; in the promotion of an agency, partner, brand or other third party; or in stock-style licensing, resale or sublicensing to others. It never allows use in any political campaign, or for training artificial-intelligence or machine-learning models, creating synthetic images of you, or biometric, facial-recognition or age-estimation purposes. Expanded commercial use is never presented as required.
3.3 How MayerPix uses the photographs. MayerPix uses the selected photographs in a professional, respectful, non-disparaging and non-misleading way. The permission is not permission to ridicule, humiliate or defame you; to materially misrepresent you or the Session; to falsely imply that you endorse MayerPix, another person, a product, a service, an organization or a position; or to use your image in a political campaign or another heightened context without your separate documented permission.
3.4 Three separate things. MayerPix keeps the copyright in the photographs (section 6). Your licence to use the photographs delivered to you is section 6. The permission in this section is your permission for MayerPix to use your likeness. None of the three includes or implies another.
How long the permission lasts, and what happens afterwards
4.1 Five years. The permission in section 3, and any further permission you give under section 5, last for five years from the Session date.
4.2 During the five years. During that time there is no right to withdraw the permission. If you ask MayerPix to stop using or to remove a photograph before the five years end, MayerPix may consider the request; it does not have to agree.
4.3 After the five years. After the five years, MayerPix does not make any new use of the photographs — no new publication, placement, repost, re-upload, new gallery, feature or compilation — without a separate permission from you. MayerPix does not have to take down what it placed during the five years; a placement that simply stays where it was is not a new use.
4.4 Asking for removal after the five years. After the five years, you may ask MayerPix in writing, without giving a reason, to remove your photographs from the public online placements MayerPix controls — all of them from this Session, or specific ones. MayerPix removes or disables those placements within 60 days of a request it can reasonably verify as coming from you. This reaches MayerPix's own website, its portfolio pages and the social-media posts it controls where removal is technically available. It does not reach copies, shares or screenshots made by others, search-engine or archive copies, printed material, or MayerPix's internal records and backups, and it does not require MayerPix to recall anything already downloaded by others. Printed materials and products made during the five years under a use you allowed may continue to be shown, distributed and sold after the five years; MayerPix does not make a new print run or a new product after them, and removal never requires MayerPix to recall, buy back or destroy a printed or physical item.
Expanded commercial use — your choice
5.1 Optional and separate. When you book, and separately from your acceptance of these Terms, MayerPix offers you the choice of also allowing expanded commercial use of selected photographs of you (C): MayerPix's paid advertising, merchandise, prints and products, licensing to others, and promotion with partners, brands or other third parties. It is optional and is not selected in advance. If you do not allow it when you book, you may allow it later in your Client Portal.
5.2 Declining changes nothing. Declining does not change the TFP price, the Session, what you receive, or anything in these Terms. Only what you expressly allow is permitted, and section 4 applies to it in the same way.
5.3 Never included. Use for training artificial-intelligence or machine-learning models, synthetic images, biometric, facial-recognition or age-estimation purposes, and political-campaign use are not among the choices and are never permitted by these Terms.
Copyright, and your use of your images
6.1 MayerPix keeps the copyright. MayerPix owns the copyright in the photographs. Nothing in these Terms transfers copyright or ownership to you.
6.2 What you may do with the images MayerPix delivers. You may use the final images MayerPix delivers to you from this Session for your own personal social-media use and in your own portfolio. You may not sell or license them, use them as stock images, use them for a brand, in paid advertising or in any other commercial way, sublicense them, or transfer them to a third party for the third party's use, unless MayerPix agrees to that in writing.
What the Session includes
7.1 The Session. The Session lasts up to the time stated in the Booking Snapshot, at the location it states. The Agreement's sections on scheduling, rescheduling, late arrival and the Session location apply.
7.2 The images. MayerPix provides up to 20 curated final images from this Session, selected by MayerPix in its creative judgment from the usable material. There is no guaranteed minimum number of images, and no fixed number of colour-corrected images, retouched images, poses, outfits, locations, crops or frames is promised. The Agreement's sections on final images, delivery timing and gallery access apply.
If the Session does not go ahead, or produces nothing usable
8.1 If you cancel or do not attend. The Agreement's sections on cancelling, rescheduling and not attending apply to a TFP Session in the same way as to any other Session.
8.2 If MayerPix cancels before the Session. Before the Session begins, MayerPix may decline or cancel a TFP Booking for a lawful business, creative-fit, communication, scheduling, scope, conduct or safety reason. MayerPix keeps a record of its reason but does not have to explain it to you in detail. If MayerPix does so, it refunds everything you have paid for the Booking and does not collect any unpaid balance. MayerPix does not owe you a reshoot, credit, discount, replacement Booking or compensation beyond that refund, unless it separately chooses to offer one. MayerPix does not use this right for an unlawful discriminatory or retaliatory reason.
8.3 A Session that did not happen gives no permission. If the Session does not take place, for any reason, MayerPix has no permission to use any photograph, whatever was accepted at booking.
8.4 A technical failure on MayerPix's side. If the Session took place, a technical failure on MayerPix's side occurred — for example lost, corrupted or irretrievable files, or an equipment or data-processing failure — and as a result MayerPix cannot deliver even one usable final photograph, you choose one of the following: (a) a full refund of everything you have paid, with no unpaid balance collected; or (b) one reshoot at no additional TFP charge, on a new date, with the amount you paid applied to it. A reshoot is a new Session: you accept the then-current Agreement and these Terms again for the new date before it. Either way, MayerPix does not use any photograph from the failed Session.
8.5 What is not a technical failure. Receiving fewer than 20 images, disliking the creative result, not getting a particular pose, outfit, crop or frame, changing your mind, or a Session that produced at least one usable final image is not a technical failure under section 8.4, and none of them entitles you to a refund or a reshoot.
8.6 Nothing usable for another reason. If the Session took place but produced no usable final photograph for a reason that is not a technical failure on MayerPix's side — for example you leave, decline to be photographed, or the conditions you chose make usable photographs impossible — no refund and no reshoot is due. MayerPix may offer a reshoot or another accommodation voluntarily; nothing is promised, and an offer once does not create an entitlement another time. No permission arises, because nothing usable exists.
Other people, and what is never permission
9.1 Each adult decides for themselves. These Terms give MayerPix permission for your likeness only. No one accepts them for another adult, and you do not give any permission on behalf of anyone else. Each other adult who will be photographed accepts these Terms personally, through the link MayerPix provides, before the Session. Where another adult is recognizable in a photograph, MayerPix uses it only with that adult's own acceptance.
9.2 Not permission. Attending or appearing in a photograph, paying, receiving an invitation or a link, having access to a gallery, receiving delivered photographs, or a pre-selected, bundled, hidden or mandatory checkbox is never permission from you or from anyone else.
The version you accepted, and changes
10.1 The version that governs. The version of these Terms shown to you when you accepted, together with the scope shown to you at that time, is the version that governs your Session. MayerPix preserves a record of your acceptance — the version, the scope shown, your enrolment details, and the date and time — and makes the accepted version available to you.
10.2 Later changes. Changes MayerPix makes to these Terms apply to later Bookings only. They do not change the version you accepted.
10.3 The rest. The Agreement's provisions on electronic acceptance, notices, governing law, venue and disputes apply to these Terms.
