Private Session Option Terms

These Terms apply when you add the Private Session option to an ordinary Session with MayerPix Photography, in addition to the Photography Services Agreement for the Booking. You accept them yourself in your Client Portal.

Private Session Option Terms

What the Private Session option is

1.1 An option for ordinary Sessions. Private Session is a paid option you may add to an ordinary Session. Its price is shown when you add the option and appears on your receipt. It is not available for a Boudoir Session, which is private without charge under its own terms.

1.2 In addition to the Agreement. These Terms apply in addition to the MayerPix Photography Services Agreement you accepted when booking. Where these Terms expressly provide otherwise for a Private Session, these Terms apply to that point; otherwise the Agreement applies.

1.3 You accept them personally. You accept these Terms yourself when you add the option in your Client Portal, before your gallery is delivered.

What Private Session gives you

2.1 No external or public use by MayerPix. With Private Session, MayerPix does not use the photographs from your Session for any external, public or commercial purpose: not on its website, in its portfolio, on social media, in marketing or advertising, in promotional materials, in editorial or public-relations use, in competitions, exhibitions or industry showcases, in art prints or products, in commercial publications, in licensing to others, or in promotion with partners or vendors, or for any comparable purpose.

2.2 The Agreement's own-use section does not apply. The permission the Agreement gives MayerPix for ordinary Sessions does not apply to a Private Session, and MayerPix does not ask you the question about further uses that it asks other Clients before the gallery opens.

2.3 What Private Session does not change. Private Session does not stop MayerPix from handling the photographs as reasonably necessary to provide and administer the service you bought: the photographer's capture and workflow, the assigned retoucher or editor, necessary access by MayerPix's owner or an administrator, your Client Portal and gallery delivery, temporary backup and recovery under MayerPix's retention practice, the technical providers MayerPix necessarily uses, security, accounting, and evidence where a legal or dispute matter genuinely requires it. None of that is permission for any external use. MayerPix does not promise that only one person will ever technically see your files.

If MayerPix later asks

3.1 MayerPix may ask; you may always decline. MayerPix may later ask your permission to use specific photographs from a Private Session. You are entirely free to decline, and nothing happens if you do — not slower delivery, not a reduced service, not a different gallery, and no pressure at any later Booking.

3.2 If you agree. If you agree, only the specific photographs you approve, for the specific uses you approve, may be used. Everything else from your Session stays private. Part B is the authorization you would see.

3.3 The Private Session price is not refunded. If you later approve specific photographs, the Private Session price is not refunded, reduced or credited. You bought the privacy protection for the whole Session, and it was in force the whole time.

Deleting your photographs early

4.1 Your choice. After delivery, you may ask MayerPix to delete the photographs from your Private Session before the ordinary access period ends, through an authenticated step in your Client Portal.

4.2 What deletion means. Deletion is permanent. Once it is done, MayerPix cannot recover the photographs, cannot retouch more of them, and cannot deliver them again.

4.3 Photographs you authorized. If you approved specific photographs for MayerPix's use under Part B, the authorized-use copies of those photographs are not deleted by an early deletion; Part B tells you this before you approve anything. If a request from MayerPix to approve specific photographs is still waiting for your answer when you ask for early deletion, you decide that request first — you may decline it — and the deletion then goes ahead.

The version you accepted

The version of these Terms you accepted for your Booking governs it. Later changes apply to later Bookings only. The Agreement's provisions on electronic acceptance, notices, governing law, venue and disputes apply to these Terms.

Part B

B.1 What MayerPix is asking. MayerPix would like your permission to use the specific photographs listed below. You see each photograph and its identifier. You decide for each one. Permission for one photograph is not permission for another, and it is never permission for the whole Session. Declining, or not answering, changes nothing about your Private Session.

B.2 What you would be permitting. For each photograph you approve, you choose the uses you allow. You may allow all three groups with one choice, or open the detail and allow any group or combination:

  • A — MayerPix portfolio and promotion: MayerPix's website and portfolio, MayerPix's social media, MayerPix's own marketing and advertising, its brochures and promotional materials, and its showcase examples;
  • B — editorial, exhibition and industry: editorial and publication use about MayerPix or photography, public relations, competitions, awards, exhibitions, and industry or professional presentations;
  • C — expanded commercial use: art prints, photo books, calendars and comparable products, commercial publications, sale of artistic works using the photograph, licensing to others, and promotion with partners or vendors.

Nothing is selected in advance. Choosing "allow all" is your own action. You may also decline everything.

B.3 What is never included. No approval here allows MayerPix to use a photograph to train artificial-intelligence or machine-learning models, to generate faces, bodies or synthetic images, or to make synthetic derivatives of you.

B.4 Ordinary adaptation. Within a use you allow, MayerPix may crop, resize, lay out, apply ordinary colour treatment to, and place the photograph in the design or campaign material for that use. That is not permission to create something new from your likeness.

B.5 How long it lasts. An approval you give for a specific photograph lasts for five years from the Session date, in the same way as the Agreement's own-use permission for ordinary Sessions, including its rules on what happens after the five years and on asking for removal afterwards.

B.6 Before you approve — please read this. If you approve a photograph, MayerPix makes a separate authorized-use copy of it and keeps that copy in protected storage, linked to your approval. That copy is kept for the uses you allowed even if you later delete your Session photographs under Part A section 4. Your own gallery and Session photographs are not moved or changed by an approval.

B.7 No answer is no permission. If you do not answer, MayerPix has no permission. Silence, delay or an unanswered request is never an approval.

B.8 Your record. MayerPix keeps a record of each approval: which photograph, which uses, your decision, when you made it, and the version of this text you saw. You can see it in your Portal.
