Boudoir Session Terms
These Terms apply to a Boudoir Session with MayerPix Photography, in addition to the Photography Services Agreement for the Booking. The adult Client accepts them personally when booking.
Boudoir Session Terms
What these Terms are
1.1 Who they are between. These Terms are between you — the adult Client booking a Boudoir Session — and Peter Mayer, doing business as MayerPix Photography ("MayerPix").
1.2 In addition to the Agreement. They apply in addition to the MayerPix Photography Services Agreement you accept when booking. Where these Terms expressly provide otherwise for a Boudoir Session, these Terms apply to that point; otherwise the Agreement applies.
1.3 You accept them personally. You accept these Terms yourself, at booking. No one accepts them for you.
Adults only
2.1 Your confirmation at booking. A Boudoir Session is for adults only. When you book, you confirm, by your own action, that you are at least 18 years old. MayerPix relies on that confirmation.
2.2 Photo ID at the Session. Before a Boudoir Session begins, the photographer or another authorized member of MayerPix's staff looks at your valid government-issued photo ID to confirm that you are an adult. No Boudoir photography begins until that check succeeds.
2.3 What MayerPix keeps. MayerPix does not photograph, scan, copy or upload your ID, and does not record your ID number or your date of birth. It records only that your age was verified, how, when, for which Booking, and by whom.
2.4 Bring your ID. MayerPix reminds you before the Session that photo ID is required. It is your responsibility to bring it.
2.5 If you are an adult but do not have your ID with you. The Session cannot begin until you present valid ID. If you can obtain and present it while scheduled Session time remains, the Session takes place in the remaining scheduled time; the scheduled end time does not move, and the Agreement's late-arrival rules apply. If you cannot, MayerPix's staff record that the required ID was not present, and you may then choose to reschedule or to cancel, even inside the 24-hour period that would otherwise prevent it:
- if you reschedule, the Agreement's rescheduling rules apply to the photography services. Where a partner studio booked through MayerPix is involved: if the studio can be moved at no charge, your studio payment moves with the date; if the studio charges an actual change fee, you pay that fee; if the original studio booking cannot be recovered and a new one must be bought, you pay the new studio cost. In each case only the actual, documented studio amount is charged, with nothing added; or
- if you cancel, MayerPix retains the Reservation Payment, refunds any amount you paid for photography services above it, and refunds a studio or other third-party amount paid through MayerPix to the extent MayerPix actually recovers it. The part a studio or other third party genuinely does not return because the Session did not go ahead may remain with you.
2.6 If your ID shows that you are under 18. The Session does not take place, and MayerPix does not make any exception — whatever the circumstances and whoever is present. Because you confirmed at booking that you were at least 18, MayerPix treats this as a cancellation by you: it retains the Reservation Payment, refunds any amount you paid for photography services above it, and refunds a studio or other third-party amount paid through MayerPix to the extent MayerPix actually recovers it; the part a studio or other third party genuinely does not return stays with you. The Agreement's sentence on why MayerPix keeps the Reservation Payment applies.
Privacy by default
3.1 Private unless you say otherwise. Photographs from a Boudoir Session are private. MayerPix does not use them in its portfolio, on its website, on social media, in advertising, in promotion, or in any other public or commercial way, unless you separately authorize a specific photograph for a specific use under Part B. Accepting the Agreement or these Terms does not give MayerPix any such permission.
3.2 Who sees your files. Access to your files is limited to the people needed to provide the service: the assigned photographer, the assigned retoucher or editor, and MayerPix's owner or an administrator where that is operationally necessary. MayerPix does not promise that only one person will ever technically see your files, and does not offer photographer-only processing as an option.
3.3 Discussing your Session. Before booking, MayerPix can answer general questions about privacy, the levels of nudity it supports, its boundaries, the age requirement and what a Session involves. Your own boundaries, poses, comfort preferences and specific requests are discussed after booking through the messages area of your Client Portal, not by email or text message. A notification sent outside the Portal only tells you that a message is waiting; it never contains what the message says.
What a Boudoir Session includes and does not include
4.1 Supported content. A Boudoir Session may include lingerie, implied nudity, artistic or full nudity, and sensual or erotic posing.
4.2 Not offered. A Boudoir Session does not include actual or simulated sexual acts, or actual or simulated masturbation. MayerPix does not photograph them.
4.3 Your safety and comfort. The Agreement's section on safety applies. You may decline any pose at any time, and the photographer may refuse or stop any pose or activity that MayerPix considers unsafe or outside section 4.1.
Your photographer
5.1 Preference. You may ask for a photographer of a particular gender. MayerPix makes a genuine effort to accommodate the request but does not guarantee it.
5.2 A replacement needs your approval. If the photographer assigned to your Boudoir Session becomes unavailable, MayerPix may propose a replacement, but does not go ahead with a replacement photographer unless you approve that person. This applies even where the replacement matches a gender preference you gave.
5.3 If you do not approve the replacement. MayerPix and you may try to agree on a new date and time. That reschedule does not use your no-charge reschedule under the Agreement and carries no rescheduling fee. If MayerPix cannot provide a photographer you approve or a reasonable new date, MayerPix refunds all amounts you have paid for the Booking, including any studio or other third-party amount paid through MayerPix, as the Agreement's section on MayerPix's inability provides.
Deleting your photographs early
6.1 Your choice. After delivery, you may ask MayerPix to delete the photographs from your Boudoir Session before the ordinary access period ends. You do this in your Client Portal, and you confirm it with a one-time code sent to the phone number verified for your Booking.
6.2 What deletion means. Deletion is permanent. Once it is done, MayerPix cannot recover the photographs, cannot retouch more of them, and cannot deliver them again. MayerPix does not keep them past the deletion for its own recovery period.
6.3 Photographs you authorized. If you authorized specific photographs for MayerPix's use under Part B, the authorized-use copies of those photographs are not deleted by an early deletion; Part B explains this before you authorize anything. If a request from MayerPix to authorize specific photographs is still waiting for your answer when you ask for early deletion, you decide that request first — you may decline it — and the deletion then goes ahead.
The version you accepted
The version of these Terms you accepted for your Booking governs it. Later changes apply to later Bookings only. The Agreement's provisions on electronic acceptance, notices, governing law, venue and disputes apply to these Terms.

B.1 What MayerPix is asking. MayerPix would like your permission to use the specific photographs listed below. You see each photograph and its identifier. You decide for each one. Permission for one photograph is not permission for another, and it is never permission for the whole Session.
B.2 What you would be permitting. For each photograph you authorize, you choose the uses you allow. You may allow all three groups with one choice, or open the detail and allow any group or combination:
- A — MayerPix portfolio and promotion: MayerPix's website and portfolio, MayerPix's social media, MayerPix's own marketing and advertising, its brochures and promotional materials, and its showcase examples;
- B — editorial, exhibition and industry: editorial and publication use about MayerPix or photography, public relations, competitions, awards, exhibitions, and industry or professional presentations;
- C — expanded commercial use: art prints, photo books, calendars and comparable products, commercial publications, sale of artistic works using the photograph, licensing to others, and promotion with partners or vendors.
Nothing is selected in advance. Choosing "allow all" is your own action. You may also decline everything.
B.3 What is never included. No authorization here allows MayerPix to use a photograph to train artificial-intelligence or machine-learning models, to generate faces, bodies or synthetic images, or to make synthetic derivatives of you. Any such use would need a separate, expressly worded permission, which MayerPix does not ask for here.
B.4 Ordinary adaptation. Within a use you allow, MayerPix may crop, resize, lay out, apply ordinary colour treatment to, and place the photograph in the design or campaign material for that use. That is not permission to create something new from your likeness.
B.5 How long it lasts. An authorization you give is permanent, and you cannot withdraw it later through the Portal or otherwise, to the fullest extent the law allows. MayerPix may, in an exceptional situation, agree to stop a future use if you ask; that is MayerPix's decision, not a right you have. This does not limit any right the law gives you that cannot be given up.
B.6 Before you authorize — please read this. If you authorize a photograph, MayerPix makes a separate authorized-use copy of it and keeps that copy in protected storage, linked to your authorization. That copy is kept for the uses you allowed even if you later delete your private Session photographs under Part A section 6. Your own gallery and Session photographs are not moved or changed by an authorization.
B.7 No answer is no permission. If you do not answer, MayerPix has no permission. Silence, delay or an unanswered request is never an authorization.
B.8 Your record. MayerPix keeps a record of each authorization: which photograph, which uses, your decision, when you made it, and the version of this text you saw. You can see it in your Portal.
