MayerPix Photography is Peter Mayer, doing business as MayerPix Photography, in Los Angeles and San Francisco, California ("MayerPix", "we"). These Terms cover your use of our website, our online booking, our client portal, our phone and chat assistant, and our communications with you. Using our website or contacting us means you accept these Terms; if you do not agree, please do not use the website.

When you book a Session, you review and accept the MayerPix Photography Services Agreement for that Booking, together with the Booking Snapshot that states the service, date, time, location, price and payment schedule for it.

That Agreement — not these Terms — is the contract for your Session: it states the price and payment schedule, cancellation, rescheduling, the medical emergency accommodation, what happens if you do not attend, what you receive and when, your licence to use your images, how MayerPix may use photographs, and how disputes are handled. Where these Terms and your Agreement differ on anything about a Session, the Agreement governs. You can view and download the version you accepted at any time from your client portal.

Some Sessions or options — paid TFP Sessions, Boudoir Sessions, the Private Session option, photographs of children, and events — are covered by a separate document that the person it applies to accepts personally. Your Agreement names them. Each applies only where we offer that Session or option.

The price you see for a package is the price you pay for it; any mandatory studio or venue amount is shown as part of the total before you can select it, and optional additional services are shown separately. Your Booking Snapshot states the Reservation Payment, the Balance and when the Balance is due. Payments are made by card, or with Apple Pay or Google Pay where your device supports them, through our payment processor (Stripe); we do not store your card details. We do not charge a late fee or interest.

Your Agreement states the rules in full.

In short: you may cancel at any time before the Session, and MayerPix retains the Reservation Payment and refunds any amount you paid for photography services above it; you may reschedule once at no charge if your request reaches us at least 24 hours before the scheduled start, and later reschedules carry the fee stated in your Booking Snapshot — that fee reserves your new time: it is not refunded if you later cancel or do not attend, and it is refunded with any full refund or if MayerPix moves or cancels the Session; a medical emergency reported before the Session opens a separate accommodation; if you do not attend and did not cancel, MayerPix retains what you paid for the Booking.

MayerPix keeps the copyright in all photographs. Once you have paid in full, you receive a licence to use your final images as your Agreement states — for an individual, personal use, social media, self-promotion and ordinary publicity about yourself, without stock-style resale or sublicensing; for an organization, its own lawful business purposes. RAW files and unselected photographs are not delivered. Final images are delivered through your client portal within the delivery commitment your Agreement states — 7 business days, or 14 for a wedding or event — and the gallery stays available for 30 days from the delivery message.

For an ordinary Session booked by an individual, accepting the Agreement permits MayerPix to use photographs in which you are recognizable in its own portfolio, on its own website and in its own unpaid social-media posts, for five years from the Session; before your gallery first opens you choose whether to allow anything more, and you may allow nothing more. A Private Session option removes even that. Boudoir photographs are private unless you authorize a specific photograph for a specific use, image by image.

MayerPix never uses a photograph of another adult without that adult's own permission, or of a child without a parent's or legal guardian's authorization, and never uses photographs to train artificial-intelligence models. Your Agreement and the separate documents state all of this in full.

You may leave an honest review of our services, including a negative one. Nothing in these Terms or in any Agreement restricts truthful statements about MayerPix.

MayerPix does not photograph in conditions it considers unsafe, and its staff do not recommend unsafe poses or places. You are responsible for your own safety and for the people you bring to a Session. MayerPix may end a Session for serious conduct — threats, harassment, dangerous or unlawful behaviour — as your Agreement states; dissatisfaction, a disagreement about style, or a review is never such a ground.

Calls to MayerPix may be answered by an AI assistant and may be recorded and transcribed for quality, training of our staff and record-keeping. You are told at the start of a call that it may be recorded; if you prefer not to be recorded, you can end the call and contact us by e-mail. Our Privacy Policy names the providers that process call audio and transcripts. We do not use your audio to train public AI models.

If you give us your mobile number, we send transactional texts about your Booking — a verification code, a booking link, a confirmation, a reminder, or a request to approve an additional service during your Session. Our SMS Terms state how to stop them. We do not send marketing texts without your separate written consent.

Your portal access is personal to you. Do not share your access links or codes. We may suspend access that is misused. The website and portal are provided as they are; we work to keep them available but do not promise uninterrupted access. Links to other websites are provided for convenience; we are not responsible for their content or policies.

Our Privacy Policy describes what personal information we collect, who processes it for us, how long we keep it, and your choices.

If a dispute arises between you and MayerPix, either of us gives the other written notice by e-mail, and we try in good faith for 15 calendar days to resolve it. After that, either of us may bring a claim in the courts of the State of California, including the small claims court where the claim qualifies. Where you booked for personal, family or household purposes, the proper county is the one California law provides for consumer contracts — the county where you signed, or lived when you booked, or live when the claim is filed.

These Terms contain no arbitration requirement and no waiver of a jury trial or of a class action.

California law governs these Terms, without regard to its conflict-of-law principles.

We may update these Terms for future bookings. The version you accepted with a Booking stays the version for that Booking. We post the effective date at the top of these Terms. If any part of these Terms is held invalid or unenforceable, the rest of these Terms stays in effect.
