Organizer Terms
These Terms apply to the Organizer of a Wedding or Event photographed by MayerPix Photography, in addition to the Photography Services Agreement for the Booking. The Organizer accepts them when booking.
Organizer Terms
What these Terms are
1.1 Who they are between. These Terms are between the Organizer of a Wedding or Event photographed by MayerPix Photography (Peter Mayer, doing business as MayerPix Photography — "MayerPix") and MayerPix. The Organizer is the Booking Client for the Event, or the person or organization the Booking Client has named as responsible for the Event.
1.2 In addition to the Agreement. They apply in addition to the MayerPix Photography Services Agreement for the Booking. Where these Terms expressly provide otherwise for an Event, these Terms apply to that point; otherwise the Agreement applies.
What the Organizer's acceptance is, and is not
2.1 Not the guests' permission. The Organizer's acceptance of these Terms, of the Agreement, or of anything else is not any guest's or attendee's own permission for MayerPix to use that person's name, image or likeness. MayerPix does not treat it as such, and these Terms never say otherwise.
2.2 What MayerPix may do without an individual permission. MayerPix may use a genuine wide or ambient crowd or group photograph from the Event in its own portfolio, on its own website and in its own ordinary, unpaid social-media portfolio posts, where every recognizable person in it is an adult who appears only because they attended, and no one is singled out in how the photograph is taken, cropped, edited, laid out, captioned, tagged, headlined, described or used. MayerPix does not use such a photograph in paid advertising, in promotion with partners or vendors, in licensing, sale or merchandising, or in any other third-party commercial way.
2.3 What always needs the person's own permission. Any use of a photograph in which an adult is individually featured, and any use of a photograph in which a child is recognizable, needs that adult's own documented permission, or the child's parent's or legal guardian's authorization, given through the process MayerPix provides. The Organizer cannot give it for them.
What the Organizer takes responsibility for
3.1 Telling attendees. The Organizer tells attendees, before and at the Event, that photography is taking place, using the attendee notice in Part B or a notice that says the same things, in the places attendees will see it — such as the invitation, the registration or ticketing terms, and signage at the Event.
3.2 Permissions the Organizer needs for its own use. Where the Organizer intends to use the photographs for its own purposes under its licence in the Agreement, the Organizer obtains any permission it needs from the people in them for that use. MayerPix does not give or promise any person's permission for the Organizer's use.
3.3 Children. Where the Organizer knows that children will be at the Event, the Organizer tells MayerPix in advance, and tells parents and guardians that photography is taking place. MayerPix's own use of any photograph in which a child is recognizable depends on the separate parent or legal-guardian authorization, which the Organizer does not give.
3.4 Consistency. The Organizer makes sure that what its invitations, registration or ticket terms and other communications say about photography is consistent with these Terms, and does not tell attendees that permissions exist which do not.
3.5 Accurate statements to MayerPix. Where MayerPix asks the Organizer what notice was given and what permissions were obtained, the Organizer answers accurately. The Organizer does not tell MayerPix that a permission exists when it does not.
3.6 Access and conditions. The Organizer arranges the venue access, the schedule, and the coordination with the venue, planner, security and other people that MayerPix needs to photograph the Event, as the Agreement's section on the Client's responsibilities describes.
If the Organizer does not do these things
4.1 The Organizer's responsibility. The Organizer is responsible to MayerPix for a failure in the notice, communications or statements that section 3 makes the Organizer's responsibility. What that responsibility consists of is stated in the Agreement and in these Terms; it does not extend to anything that was MayerPix's own responsibility.
4.2 What this does not do. Nothing in this section is a guest's or attendee's permission, and nothing in it affects any right a guest or attendee has. It concerns only the position between the Organizer and MayerPix.
Galleries and access
5.1 Access is not permission. Where the Organizer or the Booking Client chooses to give approved adult guests access to a shared Event gallery, that access is access only. It does not give MayerPix, the Organizer or anyone else permission to use any person's image, and it does not change any permission that exists.
5.2 The Organizer's choice. Whether guests receive gallery access at all, and which guests, is the Organizer's or Booking Client's choice, made at booking. Where no choice is made, only the Booking Client has access. Where access is granted, the shared gallery may include photographs in which children appear.
The version accepted
The version of these Terms the Organizer accepted for the Booking governs it. Later changes apply to later Bookings only. The Agreement's provisions on electronic acceptance, notices, governing law, venue and disputes apply to these Terms.
Attendee photography notice
For the Organizer to display or distribute
Photography at this event. This event is being photographed by MayerPix Photography for the organizer. Photographs may include guests. The organizer may use the photographs for its own purposes as agreed with the photographer. The photographer may show genuine wide crowd or group photographs of adult guests in its own portfolio, on its own website and in its own social-media portfolio posts; it does not use them in advertising or sell or license them. The photographer does not feature an individual adult guest, and does not use any photograph in which a child is recognizable, in its own portfolio or elsewhere without that adult's own permission or the child's parent's or guardian's authorization. If you would rather not be photographed, please tell the organizer or the photographer.
